Lower Frederick open burning ban in effect until further notice

Violators can be prosecuted on a summary offense and pay up to a $1,000 fine

An open burning ban continues to be in effect in Lower Frederick Township.

The township supervisors issued a ban on March 12.

All current ban permits are now invalid.

Lower Frederick administration will update its residents on the ban on its Facebook page and its website.

Once the ban is lifted, all ban permits will remain invalid and new permits will be required, according to the township.

According to the township code, there are the following exceptions to the open burning ban, when approved by the Air Pollution Control Officer:

  • Open burning of dry twigs, dry branches and other native vegetation, on piles larger than five feet by five feet by five feet
  • Burning to prevent or abate a fire hazard
  • Burning for the purpose of instructing personnel in fire fighting
  • Burning for the prevention and control of disease or pests
  • Burning in conjunction with the production of agricultural commodities in their unmanufactured state on the premises of the farm operation.
  • Burning of trees, shrubs, and other native vegetation which are cleared from land during or prior to the process of construction  
  • Burning for the purpose of destroying domestic refuse, when the fire is on the premises of any structure occupied solely as a dwelling by two families or less and when such refuse results from the normal occupancy of said structure.
  • Open burning for recreational or ceremonial purposes.
  • Open burning, under the continuous supervision of an adult, for cooking food upon a grill with a properly fitting lid which is kept closed and covered at all times when the user is not tending food.


Per township code, violators can be charged and convicted of a summary offense and be forced to pay a fine of no more than $1,000, plus court costs. If the violator defaults on payment, then they can be jailed for up to a month.
