A felony charge of aggravated assault with deadly force on an officer was withdrawn at a preliminary hearing Tuesday against a Montgomery County Correctional Facility inmate accused of spitting in the face and mouth of a corrections officer.
Other charges of felony aggravated harassment by a prisoner and misdemeanor recklessly endangering another person were held for Montgomery County Common Pleas Court against Joseph Kurtz, 27, of 600 block of Buck Run Road, East Fallowfield, PA.
On Oct. 31, at 1:10 p.m., several corrections officers, including a corporal, entered the housing section at Montgomery County Correctional Facility on Eagleville Road in Lower Providence to escort Kurtz to a video court appearance. During the escort, Kurtz allegedly refused to move or follow commands given by corrections officers.
Kurtz then intentionally spit at the corporal, hitting him in the face and mouth with saliva, police said. The victim was taken to an outside medical facility for further treatment, police said. After an investigation, Kurtz was eventually charged in mid-November 2024.
Arraignment in county court is set for Aug 27. Kurtz remains jailed on $25,000 cash bail, per court documents. Kurtz is represented by a public defender.
