Charges dismissed against Montco inmate accused of spitting in face of guard

An inmate at Montgomery County jail accused of spitting in the face of a guard while he was being removed from restraints had all charges dismissed ahead of a preliminary hearing this month.

Sheldon Todd Weaver, 44, of the 100 block of Primrose Lane, Pottstown, was originally charged March 20 by Montgomery County detectives with felony aggravated harassment by a prisoner, aggravated assault, and misdemeanor recklessly endangering another person, according to charging documents.

All charges were dismissed April 22, per court records.

Police said on March 3 at 8:54 p.m., a correctional officer was on duty inside the jail, assisting other officers with escorting Weaver from his cell to the medical department, due to displaying abnormal behavior and throwing items about his cell.

Hand and leg restraints were put on Weaver and he was taken to the medical department, where he was treated by personnel and deemed to be rehoused for further observation, police said in the complaint.

Weaver was told to place his knees on his bed in order for restraints to be removed, police said. At that time, Weaver allegedly turned his head and spit in the face of an officer.

Weaver was restrained and a protective hood was put over his head, police said. The victim was relieved of duties, seen by medical personnel, and later cleared for duty, police said.

The incident was captured on body-worn cameras, police said.
