Man charged with felony trespassing after attempting to break into home to rescue girlfriend, police say

A 24-year-old Collegeville man is charged with felony criminal trespassing by breaking into a structure and other misdemeanor offenses stemming from an incident on Highland Avenue in Lower Providence Township Sunday night.

Robert James Luminella, of the 500 block of Gravel Pike, formerly of the 500 block of Hancock Court, Trappe Borough, was also charged Sunday by Lower Providence Police with misdemeanor criminal mischief, defiant trespassing, loitering and prowling at night time, possession of a small amount of marijuana, and possession of drug paraphernalia, according to court records.

Luminella is free on $5,000 unsecured bail, according to court records.

On Sunday, at 8:26 p.m., police were dispatched to the unit block of Highland Avenue for a report of a suspicious person banging on their front door, per the complaint. Upon arrival, police spoke with Luminella, who said he was there because his girlfriend lives inside the home and was being abused by her new boyfriend, per the affidavit.

Police said Luminella told them he started to bang on the door and break the screen door glass because he heard his girlfriend say, “Come in, he’s beating me.”

The property owner told police he had no idea who Luminella was and he was the only one inside the home, police said. The homeowner told police Luminella was not welcome and signs were posted “No Trespassing” on the property, according to the affidavit.

When the homeowner heard glass shattering after the loud kicking and banging on his door, he called police, per the complaint.

Luminella was placed into custody and a small black package labeled “Cannabis Flower” was found in his pants, police said, with suspected marijuana inside.

A backpack located on the driveway that belonged to Luminella contained small clear plastic vials, police said.

Police allege Luminella was maliciously loitering and prowling around the home at night, per the affidavit.

A preliminary hearing is scheduled for Oct. 15 at 10:45 a.m. before Magisterial District Judge Cathleen Kelly Rebar.

According to court records, Luminella was formally arraigned Wednesday in Montgomery County Common Pleas Court on misdemeanor drug offenses from a Limerick Township arrest in November 2023.
