Man with two prior DUI convictions accused of backing into car in parking lot while drunk, police say

 A Skippack Township man with two alcohol-related license suspensions and two DUI convictions has been charged with felony DUI, felony DUI-Unsafe Driving, and other offenses after allegedly backing into an Audi in the parking lot of a Skippack Pike restaurant, urinating himself in the process.

David Francis Kemler, 55, of the 1000 block of Bridge Road, was also charged by Pennsylvania State Police Oct. 30 with misdemeanor driving a car with a suspended or revoked license for with a BAC of .02% or more – third offense, and summary charges of driving a car without a valid license, careless driving, and speeding, according to charging documents.

Kemler is free on $2,500 unsecured bail, per court records.

According to the criminal complaint, a trooper was dispatched to Basta Pasta, 4052 Skippack Pike, Skippack Township, on Oct. 30 at 7:37 p.m. for a report of a man, identified as Kemler, backing up and crashing a 1999 blue Chevrolet Suburban into a parked, unoccupied black 2009 Audi A4.

Upon arrival, the victim told police he was eating dinner outside, when he watched Kemler back quickly into his car, and then exit the Suburban, per the complaint. When confronted by the victim, Kemler walked away and said it was not a big deal, police said.

Kemler told police he was backing up his friend’s SUV and then hit a parked car in the lot, per the affidavit. Police allege Kemler had a strong odor of alcohol on him, was wearing disheveled clothing, and had urinated himself.

Police asked him how much he had to drink, and Kemler allegedly said four drinks and one shot, before driving the SUV. Police said Kemler admitted to driving the SUV and crashing it in the parking lot.

Kemler failed field sobriety tests, but agreed to a breathalyzer, which showed a positive sign of alcohol, police said. He was placed under arrest and refused a chemical blood test for BAC, according to the affidavit.

Troopers discovered Kemler’s license was suspended twice and the incident at Basta Pasta would be his third DUI conviction within a 10-year period, per the complaint.

A preliminary hearing is scheduled for Nov. 20 at 2:30 p.m. before Magisterial District Judge Adam T. Katzman.
