A Lower Providence man has been charged with felony DUI of a combination of drugs and alcohol and misdemeanor DUI offenses after authorities said he had a BAC of .152% and fentanyl in his system during a single-vehicle crash the morning of Dec. 6.
Kerry Alan Morath, 55, of the 500 block of Highgate Road, was charged Dec. 24 by Lower Providence Police with felony DUI, misdemeanor DUI with a BAC between .10 and .16%, misdemeanor DUI-general impairment, and summary offenses of careless driving, failure to wear a seatbelt, and failure to drive in a single traffic lane, according to court documents.
On Dec. 6, at 8:22 a.m., police were dispatched to a pickup truck crash on North Park Avenue near Breckenridge Boulevard in Lower Providence, in which Morath drove his Ford F-150 off the roadway, striking a telephone pole and injuring himself, per the affidavit.
Morath allegedly told police he drank a half-pint of vodka in the morning, and various alcoholic beverages were found unopened in the pickup truck. Morath’s eyes were bloodshot and glassy and his breath and body smelled strongly of alcohol, police said.
Morath was also lethargic and overly relaxed, despite the crash, police said.
Police had Morath transferred to Paoli Hospital for trauma care by Lower Providence EMS, according to the complaint.
On Dec. 18, a search warrant was conducted on the hospital’s medical records for Morath’s treatment on Dec. 6, police said.
The analysis of the blood drawn on Dec. 6 showed a BAC of .152% and a urine sample of Morath revealed positive results for fentanyl metabolites, opiates, morphine and oxazepam, according to the complaint.
Morath’s driving record showed two previous offenses and convictions of the vehicle code in September 2016 and February 2017, police said.
All suspects and defendants are innocent until proven guilty. This story was compiled using public court records.
